Agreement to Terms

Declaration

This Air Waybill (AWB) is non-negotiable. Carriage under this instrument is subject to the Unique Brothers Logistics terms and conditions outlined herein, which have been read and accepted by the consignor. The liability of Unique Brothers Logistics, or its servants, agents, or privies for any loss or damage is limited to the terms and conditions of carriage stated in this document. The consignor acknowledges having carefully read the instructions, declarations, terms, and conditions of this contract and agrees that the information provided is correct in every material detail.

Important Notice

By the conditions set forth in this document, Unique Brothers Logistics and its servants, agents, and privies shall not be liable for certain losses and damages. Furthermore, wherever they may be liable, the amount of liability is strictly limited as detailed in condition (B)(5) below.

A. Our Contract with You

  1. Terms and Conditions
    These terms and conditions govern the contract between the sender of the shipment (consignor) and Unique Brothers Logistics Ltd. When you provide us with your shipment, you accept our terms and conditions of carriage for yourself and anyone else with an interest in the shipment. Our terms also protect any parties we may contract with to collect, transfer, or deliver your shipment. No employee or individual has the authority to alter, misconstrue, or misinterpret these terms or make any alternative promises on our behalf.

  2. Definition of Shipment or Waybill
    "Shipment" or "waybill" refers to all documents, parcels, or goods that fall under our delivery documentation. You agree and certify that the shipment details are complete and accurate as written on this airway bill.

  3. Inspection and Charging
    All goods for shipment must be open and inspected in the presence of the sender and charged at 10% of the shipment’s value or the prevailing tariff. However, the carrier reserves the right to inspect the goods without prior notice to the consignor, including the right to open and examine the goods. Security agencies also have the right to open and examine all shipments that fall under our delivery services.

  4. Claims for Lost or Damaged Shipments
    Claims for lost or damaged shipments must be made in writing by the shipper and received at the head office of Unique Brothers Logistics within 14 days from the date the shipment was supposed to arrive at the destination.

  5. Extent of Our Liability
    Subject to clause A(1) above, the carrier will only be liable for direct loss and damage, limited to 20% of the declared value of the shipment at the point of registration, evidenced by appropriate purchase receipts. All other types of loss or damage are excluded, including, but not limited to, loss of profit, income, interest, and future business. Unique Brothers Logistics shall not be liable for any special or indirect loss or damage, even if the risk associated with such loss or damage was communicated directly or indirectly to the carrier before or after the acceptance of the shipment. Claims are limited to one claim per shipment, and settlement will constitute full and final resolution for all losses or damages connected therewith.

If the shipper considers the limits provided in clauses 5 and 3 insufficient, they must make a special declaration of value and request a Service Level Agreement (SLA) as directed by the company. This agreement must be signed by the CEO. It is important to note that Unique Brothers Logistics is not liable for consequential damages or losses caused by transport delays, including road accidents, armed robbery, riots, strikes, or government legislation.

  1. Delay in Shipments
    We will make every reasonable effort to deliver your shipment according to our normal delivery schedules; however, these are not guaranteed and do not form part of the contract. Unique Brothers Logistics shall not be liable for any damage or loss caused by delays due to vehicle breakdowns, chaotic traffic conditions, armed robbery attacks on carrying vehicles, unfavorable weather conditions, fire outbreaks, or accidents (land, air, or sea).

Circumstances Beyond Our Control

We are not liable if a shipment is lost, damaged, or misdelivered due to circumstances beyond our control. This includes, but is not limited to:

  • Fire disasters of any kind
  • Acts of God (e.g., earthquakes, cyclones, storms, floods)
  • Force majeure events (e.g., war, plane crashes, floods, theft, civil unrest)
  • Actions or omissions by public authorities, third parties, receivers, and independent contractors
  • Any action, inaction, commission, or omission by anyone outside Unique Brothers Logistics, such as landlords, co-tenants, shippers, receivers, interested third parties, customs, or any government bodies.

Additionally, we are not liable for electrical or magnetic damage to, or erasure of, electronic images or recordings.

Prohibited Items

All consignments accepted by Unique Brothers Logistics must not contain any prohibited or contraband items, including, but not limited to, hazardous materials and dangerous goods such as explosives, weapons, radioactive or corrosive materials, narcotics, pornographic materials, flammable liquids, live animals, precious metals or stones, currency, international passports, military materials, and more, as prohibited by the International Air Transport Association (IATA), the International Civil Aviation Organization (ICAO), and relevant local laws. Fragile and perishable items are at the owner's risk, and we do not accept such deliveries.

Special Notice

In cases of lost or damaged documents, the shipper will be responsible for replacing the documents, which the carrier will deliver free of charge. However, if the documents are irreplaceable, the carrier's liability is limited to N2,000 (two thousand naira only).

Agreement to Terms

By giving Unique Brothers Logistics your consignment, the consignor agrees—regardless of whether he/she signed the front of this waybill for himself or as an agent on behalf of any other person having an interest in the consignment—to all terms in this non-negotiable waybill. No one is authorized to alter or modify the terms of this carriage. The waybill shall be binding on both Unique Brothers Logistics and the consignor when the consignment is accepted. Unique Brothers Logistics may mark the waybill with a signature or number.
