AGREEMENT TO TERMS

DECLARATION

This AWB is non nonnegotiable. carriage on this instrument is subject to the unique brothers logistics terms and conditions hereinafter set forth and which have been read and agreed with by the consignor. The liability of unique brothers logistics or its servant, agent or privies for any loss or damage is limited to the agreement of terms and conditions of carriage under this instrument. The consignor acknowledge having carefully read the instructions, declarations, terms and conditions of this contract and also agree that the information supplied and written are correct in every material details and particular.
IMPORTANT NOTICE
By the conditions set out in these present, unique brothers logistics and its servant, agent and privies are not to be liable at all for certain loses and damages and secondly wheresoever they are liable, the amount of liability is strictly limited in condition (B) (5) hereunder. A= our contract with you.
1=This are terms and conditions governing the contract between the sender of the shipment (consignor) and unique brothers logistics ltd. when you give us your shipment, you accept our terms and conditions of carriage both for yourself and anyone else who has interest in the shipment. Our terms and conditions also protect anyone who we may contract to collect, transfer, or deliver your shipment. No other employee or anyone else has authority to change or misconstrue or misinterpret these terms and conditions or make any alternative promise on our behalf.
2. what shipment or waybill means. shipment or waybill means all documents/parcel/goods that comes under our delivery document. you agree and certify that shipment details are complete and accurate as written on this airway bill.
3. inspection and charging. All goods for shipment must be open and inspected in the presence of the sender and charged at 10% of the value of the shipment or prevailing tariff, however the carrier had a right to inspect the goods without a prior notice to the consignor which include the right to open and examine the goods. Security agency has a right to open and examine all shipment that comes under our delivery.
4 claim for lost or damaged shipment must be made by the shipper in writing and received at the head office of ubl within 14 days from the date the shipment is supposed to be received at the destination station.
5 what we are liable for [Extent of our liability] (subject to clause A(1) above and in respect of any shipment, the carrier will only be liable to direct loss and damage only and this shall be limited to the 20% of the declared value of the shipment at point of registration evidence with relevant and appropriate purchase of receipt, all other types of loss or damage are excluded and this includes but not limited to lost of profit income, interest,and future business. Unique Brothers Logistics shall not be liable for any loss or damages that's special or indirect even if the risk (financial or otherwise) associated with such loss or damages was communicated directly or indirectly to the carrier before or after the acceptance of the shipment. claims are limited to one claim per shipment, settlement of which will be full and final settlement for all loss or damages in connection therewith. If the shipper regards the limit provided in clause 5 and 3 as insufficient then the shipper must make a special declaration of value and request for Service level agreement (SLA) as directed by the company. This agreement must be signed by CEO of the company. It is important to note that ubl is not liable for consequential damages or loss caused by transport delay including road accident, armed rubbery, riot, strike or occasioned by government legislation etc.
6 What We Are Not Liable For Delay Shipments: we shall make every reasonable effort to deliver your shipment according to our Normal delivery schedules, but these are not guaranteed and do not forme part of the contract. unique Brothers Logistics shall not be liable for any damage or loss caused by delay such as vehicle breakdown, chaotic traffic congestion,armed rubbery attack on the carrying vehicle, unfavorable weather conditions, fire outbreak, accident (land, air or sea)

Circumstances Beyond Our Control. we are not liable if a shipment lost damaged or misdelivered because of circumstances Beyond our Control which includes but not limited to: *fire disaster of any kind of nature
*act of God, e.g Earthquake, cyclone, storm or flood etc
* force majeure e.g war,plan crash, flood, theft, hostilities, embargo, civil unrest, industrial action etc and act of omission by public authority, third parties, Receivers and act of independent contractor.
*Any action, inaction, commission or omission by anyone outside ubl such as :
-landlords , co-tenants or their servant agent and privies
-the shipper
-the receiver
-Any interested third party
-customs or any other government body or their official
the postal services other carrier or third party who we may contract to serve location that we do not serve directly, further more, we are not liable even if the sender did not ask for or know about third party arrangements. we are also not liable for electrical or magnetic damage to or erasure of electronic or photographing images or recording

PROHIBITED ITEMS
All consignment to be accepted by ubl must not contain any prohibited or contraband items or materials including but not limited to hazardous materials, dangerous goods such as explosive, weapon/ammunition, radioactive or corrosive materials, cocaine, heroin, marijuana, pornographic materials, tramadol, Flammable liquids, live Animals, gold, diamond, silver, or any precious stones, currency of any kind, international passport with visa, live examination paper, Military/ paramilitary materials of any kind etc as prohibited by the International Air Transport Associated -IATA, the International Civil Aviation Organization -ICAO, and laws, Regulation or status of any federal, state or local government of the Originating items or materials and the designation. fragile and perishable items are at the owners risk, ubl does not accept such delivery of any kind. special notice. in the case of lost or damaged documents, the shipper will replace the documents of which the carrier will deliver free of charge but whereby the documents is irreplaceable the carrier liability is limited to N2000 (two thousand naira only)

AGREEMENT TO TERMS
by given UBL your consignment, the consignor agrees, regardless of whether he/she signed the front of this waybill for himself or as an agent for and on behalf of any other person having interest in the consignment, to all terms in this Non-negotiable waybill. No one is authorized to alter or modify the terms of this carriage. The waybill shall be abiding on both Ubl and the consignor when the consignment is accepted. ubl may mark the waybill with a signature or number. all complain or queries regarding lost or damaged shipment must be made to 08068614861 This Terms and conditions of carriage shall govern by government by the law of the federal republic of Nigeria and subject to the court of competent jurisdiction
